1. Sponsor
The Contest is sponsored by NextTribe (“Sponsor” or “NextTribe”), based in Austin, Texas.
2. Eligibility
The Contest is open only to anyone who is 45 years of age or older as of the date of entry and identifies as a woman. Employees of NextTribe, its affiliates, subsidiaries, advertising and promotion agencies, suppliers, and their immediate family members (spouse, parents, siblings, and children) and/or those living in the same household of such individuals are not eligible to participate. The Contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
3. Agreement to Rules
By participating, each entrant (“You” or “Entrant”) agrees to be fully and unconditionally bound by these Official Rules and represents and warrants that You meet the eligibility requirements. You also agree to accept the decisions of NextTribe as final and binding as they relate to the content and conduct of this Contest.
4. Contest Period
The Contest begins at 12:00 p.m. Eastern Time (ET) on Feb. 15 and ends at 11:59 p.m. ET on May 15 (the “Contest Period”). All entries must be received by the deadline listed above. NextTribe’s computer is the official timekeeping device for this Contest.
5. How to Enter
NO PURCHASE NECESSARY. YOU DO NOT HAVE TO BUY A NEXTTRIBE MEMBERSHIP OR SIGN UP FOR A NEXTTRIBE TRIP. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
To enter the Contest, visit NextTribe during the Contest Period and complete the online entry form. You will be required to provide:
- Your name, email address, city, and state of residence
- Upload at least one (1) digital photograph in JPEG format
- A brief caption describing the photo, including location and what made the moment awe-inspiring (maximum 150 words)
Entry Limits: Each Entrant may submit up to six (6) photographs during the Contest Period.
Entry Requirements: Entries that are incomplete, illegible, corrupted, or do not comply with these Official Rules may be disqualified at NextTribe’s sole discretion.
6. Photo Submission Requirements
All photographs must meet the following requirements:
- Photographs must be Your own original work, taken by You
- Images must be JPEG or PNG, with a minimum of 1200px on at least one sideand a maximum file size of 6 MB per image.
- Photographs must feature destinations (international or domestic) that inspire awe, whether through a natural or man-made landscape or feature. Images can include man-made structures or features and can include people as well, as long as the people are design elements, not the primary focus of the photo.
- Standard photo editing (cropping, color correction, minor adjustments) is permitted; however, significant digital manipulation, compositing, or AI-generated images are NOT accepted
- Photographs must not contain watermarks, logos, signatures, or other identifying marks
- Photographs must not violate or infringe upon any third party’s copyright, trademark, or other intellectual property rights
- If the photograph contains recognizable people, You must have obtained all necessary model releases and permissions
- Photographs must not contain obscene, defamatory, sexually explicit, or otherwise objectionable or inappropriate content, as determined by NextTribe in its sole discretion.
7. Prizes
The following prizes will be awarded:
1st Prize: $2,000 credit to any NextTribe trip OR $1,000 in cash. Plus we will feature you and your work in an article in the magazine.
2nd Prize: $1,000 trip credit OR $500 in cash. Plus, the winning photo will be published in the magazine.
3rd Prize: $500 trip credit OR $250 in cash. Plus, the winning photo will be published in the magazine.
Honorable Mentions: $100 in trip credit plus publication in the magazine.
Total maximum retail value of all prizes: $4,500
Prizes are non-transferable. NextTribe reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable. All federal, state, and local taxes on prizes are the sole responsibility of the winner. Winners who are from the United States will be required to provide their Social Security Number or Taxpayer Identification Number for tax reporting purposes. For prizes valued at $600 or more, NextTribe will issue IRS Form 1099-MISC to the winner.
8. Winner Notification and Requirements
Potential winners will be notified by email and will be required to complete and return an Affidavit of Eligibility, Liability Release, and (where legal) Publicity Release within seven (7) days of notification. If a potential winner does not respond within this timeframe, fails to comply with these Official Rules, or if any prize notification is returned as undeliverable, the potential winner will be disqualified and an alternate winner may be selected.
Winners must provide valid government-issued photo identification and proof of eligibility upon request. All winners agree to execute any additional documents NextTribe may require to verify eligibility and secure releases.
9. Rights Granted
Each Entrant retains copyright ownership of their submitted photograph. However, by entering the Contest, you grant NextTribe and its affiliates a non-exclusive, royalty-free, worldwide, perpetual, irrevocable license to use, reproduce, display, publish, distribute, modify, create derivative works from, and otherwise exploit Your photograph and caption in any media now known or later developed for purposes of advertising, promotion, and publicity of NextTribe’s services, website, newsletter, social media, and related materials. NextTribe will provide photographer credit when reasonably feasible.
By entering, You also grant NextTribe permission to use Your name, city and state of residence, photograph, likeness, and voice for advertising, promotional, and publicity purposes in any media worldwide without additional compensation, notification, or approval, except where prohibited by law.
10. Representations and Warranties
By submitting a photograph, You represent and warrant that:
- The photograph is Your original work and You own all rights to it
- The photograph does not infringe upon any copyright, trademark, or other intellectual property rights of any third party
- You have obtained all necessary permissions, releases, and consents from any persons appearing in the photograph
- The photograph has not previously won a prize in any other contest
- The photograph complies with all requirements set forth in these Official Rules
You agree to indemnify and hold harmless NextTribe from any claims, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising from any breach of these representations and warranties.
11. Privacy
Information collected from Entrants is subject to NextTribe’s Privacy Policy, available here. By entering, You consent to the collection and use of Your personal information as described in the Privacy Policy and these Official Rules.
12. General Conditions
NextTribe reserves the right to cancel, suspend, or modify the Contest if fraud, technical failures, or any other factor beyond NextTribe’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by NextTribe in its sole discretion. NextTribe reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules.
Any attempt by an Entrant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. Should such an attempt be made, NextTribe reserves the right to seek damages and other remedies to the fullest extent permitted by law.
13. Limitation of Liability
By entering, You agree to release and hold harmless NextTribe and its parent companies, subsidiaries, affiliates, directors, officers, employees, and agents (collectively, the “Released Parties”) from any and all liability, loss, injury, damage, or claim related to: (a) participation in the Contest; (b) acceptance, possession, use, or misuse of any prize; (c) technical failures of any kind, including malfunctioning of any computer, cable, network, hardware, software, or other equipment; (d) unavailability or inaccessibility of any transmissions or telephone or Internet service; (e) unauthorized human intervention in any part of the entry process; or (f) electronic or human error in the administration of the Contest.
IN NO EVENT WILL THE RELEASED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR PARTICIPATION IN THE CONTEST, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
14. Governing Law and Disputes
This Contest and these Official Rules shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. By entering, You agree that any disputes, claims, or causes of action arising out of or connected with this Contest shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate state or federal courts located in Buncombe County, North Carolina. You hereby consent to the jurisdiction and venue of such courts.
15. Winner’s List
The names of the winners will be published on NextTribe.com and announced in a NextTribe newsletter within 60 days of the end date, May 15th.
16. Tax Responsibilities
IMPORTANT TAX NOTICE: All prizes are taxable income for citizens of the United States. Winners are solely responsible for all federal, state, and local taxes on their prizes. For any prize valued at $600 or more, NextTribe will report the prize value to the Internal Revenue Service and issue Form 1099-MISC to the winner. Winners may be required to provide their Social Security Number or Taxpayer Identification Number before receiving their prize. Failure to provide the required tax information may result in disqualification and forfeiture of the prize.
